Troutman Amin, LLP Announces Partner Puja J. Amin’s Overview of Changing SMS Outreach Rules

Irvine, California, August 7th, 2026, FinanceWire

Troutman Amin, LLP announced today that partner Puja J. Amin has published a comprehensive overview of evolving federal and state regulations governing outbound SMS marketing in The National Law Review.

The article, titled “Marketing Text Messages May Not Trigger the TCPA’s Do Not Call Rules—But They Definitely Trigger These Critical State Telemarketing Laws,” was published on July 28, 2026. It examines recent court decisions affecting the application of the Telephone Consumer Protection Act, commonly known as the TCPA, while highlighting state-level telemarketing laws that may continue to regulate manually sent marketing text messages.

Federal court decisions have continued to shape how certain TCPA provisions apply to outbound messaging channels. At the same time, several states have introduced or considered regulations that create additional compliance obligations for businesses conducting SMS marketing campaigns.

Amin’s article provides businesses, call centers, lead generators, advertisers, and performance marketing companies with an overview of the evolving regulatory environment and the potential risks associated with relying solely on federal TCPA interpretations.

“We are always pleased to assist our clients with their telecommunications and outbound marketing compliance needs,” Amin said. “I wanted to provide businesses across the country with a more comprehensive overview of the complex federal and state rules surrounding SMS messaging.”

In the article, Amin explains that although recent decisions may reduce federal TCPA Do Not Call exposure for certain manually sent marketing text messages, businesses may remain subject to state telemarketing statutes, often referred to as mini-TCPAs.

“While Stendinger and certain district court decisions may significantly reduce federal TCPA DNC exposure for manually sent marketing texts, many states expressly regulate text messages—even when they are sent manually,” Amin wrote. “Businesses considering manual SMS campaigns should recognize that state mini-TCPAs may still present compliance risks, including in jurisdictions where courts have held that text messages do not constitute calls under certain TCPA provisions.”

The article is particularly relevant to the lead generation, affiliate marketing, performance marketing, and consumer contact industries, where outbound SMS is frequently used to communicate with consumers following expressions of interest or other intent signals.

Before joining Troutman Amin, LLP, Amin served as in-house counsel for a major non-bank mortgage servicer and as general counsel for a digital advertising company. Her practice focuses on telecommunications law, marketing compliance, consumer privacy, advertising regulations, and litigation risk.
